When someone dies as the result of the negligence of others it is called Wrongful Death

Virginia law now recognizes that there is no true reparation for wrongful death…therefore, there is no dollar limit on the amount that may be recovered

Current law stipulates that only beneficiaries are entitled to recover money…

• For a child, it is the parents and brothers & sisters.
• For a parent, it is the spouse and children.
• The recoverable amount is determined by statute, and generally includes the loss of support (wages for a spouse & children dependent upon them), companionship, and advice.
